What happens after I finish?
Once you complete this questionnaire, we'll search the availability of your trademark and then submit your application to the U.S. Patent and Trademark Office (USPTO). We provide lifetime customer support and a 100% satisfaction guarantee to all customers.
The USPTO reviews and approves trademark applications for federal registration. However, not all trademark applications are accepted and approved. Here are some of the USPTO's most common grounds for rejecting applications.
After you've reviewed what the USPTO looks for in a trademark, including common grounds for rejection, click the Save and Continue button.
You can file a trademark application even if you haven't started using it to sell a product or service yet. However, to complete the application process, you will eventually need to be using the trademark in commerce and provide proof to the USPTO (we can help at that point in the process too).
If you choose "Yes", you will be required to submit proof of use for your trademark application to be complete and filed. Guidelines for submitting proof are provided in the next pages, and detailed instructions will be given after you complete your questionnaire.
Check "No" if you have not started using your trademark in the U.S. to sell the products or services. Even if you haven't started using your trademark, an "Intent-to-Use" application provides great advantages, such as an early filing date.
Please note: If you choose "No", you will eventually need to start using your trademark in commerce and complete another filing with the USPTO later -- a "Statement of Use" along with proof of the trademark's use and additional fees -- to receive federal registration. You should also have documents showing your intent to use the trademark as soon as your filing date, such as a business plan, mock-ups of your trademark and/or other proof showing that your genuine intent exists.

The USPTO requires you to submit proof (called a "specimen") showing that you are using your trademark to sell your products and/or services. This proof is not just a drawing or rendering of your trademark, but is a real world example of its use. We will give you instructions on how to submit your specimen to us after you complete your questionnaire.
